COVID-19 RESCUE ACT VACCINATION LOTTERY PROGRAM ENTRY FORM

Board of Directors Establishes the COVID-19 Rescue Act Vaccination Lottery to Help Mitigate the Spread of COVID-19

SAULT STE. MARIE, Mich.— The Sault Ste. Marie Tribe of Chippewa Indians (“Tribe”) Board of Directors has established a COVID-19 Rescue Act Vaccination Lottery Program (“Vaccination Lottery”) to motivate and incentivize Tribal Members and Team Members to get vaccinated and to mitigate the spread of COVID-19. The Vaccination Lottery will be funded with the Tribe’s American Rescue Plan Act State and Local Fiscal Recovery Funds and other federally approved vaccination funding received by the Tribe.
 
The Vaccination Lottery will include three (3) Team Member drawings and (3) Tribal Member drawings per month from December 2021 through April 2022 (30 drawings total). Eligible winners will receive $5,000.00 each. To enter the Vaccination Lottery, participants must fill out and submit only one Entry Form on the Tribe’s website. Eligible participants will automatically qualify for the next month’s drawing(s) if they did not win during the prior month.
 
To be eligible to participate in the Vaccination Lottery, Tribal Members and Team Members must be eighteen (18) and older as of the date they submit an Entry Form on the Tribe’s website. Additionally, to be eligible to receive a Vaccination Lottery prize, Tribal Member or Team Member drawing winners must provide proof that he or she received at least one (1) dose of an approved COVID-19 vaccination as of the date the Entry Form was submitted. As of the enactment of the Vaccination Lottery, approved vaccines are the Pfizer, Moderna, and Johnson & Johnson COVID-19 vaccines.
 
Tribal Member drawing winners must submit proof of their enrollment in the Tribe as of the date the Entry Form was submitted and as of the drawing date. Tribal Members are not required to submit their Red Number to apply or receive a prize. Similarly, Team Member drawing winners must submit proof of their employment with the Tribe as of the date the Entry Form was submitted and as of the drawing date.
 
Tribal Members who are also Team Members of the Tribe are eligible to enter both drawing categories and are eligible to win up to one (1) prize from each drawing category. All other eligible participants may only receive one (1) prize from the Vaccination Lottery.

COVID-19 RESCUE ACT VACCINATION LOTTERY PROGRAM

1. Purpose and Intent. The Sault Ste. Marie Tribe of Chippewa Indians (“Tribe”) Board of Directors has established the COVID-19 Rescue Act Vaccination Lottery Program (“Program”) to respond to the COVID-19 public health emergency by motivating and increasing the number of people that get vaccinated sooner than they otherwise would have.
 
2. Finding of Need. The Board of Directors has determined that this Program and the assistance provided thereunder are necessary to increase vaccination rates among Tribal Members and Team Members.
 
3. Eligibility. Tribal Members and/or Team Members who are eighteen (18) and older as of the date of the Entry Form are eligible to participate in the Program. Additionally, to be eligible to receive a prize from the Tribal Member Drawing or a Team Member Drawing, an individual must have received at least one (1) dose of an approved COVID-19 vaccination as of the date of the Entry Form.
 
a) Vaccination Requirement. Drawing winners must provide valid proof that he or she has received either one(1) dose of a Pfizer or Moderna COVID-19 vaccine or (2) the single dose of the Johnson & Johnson COVID-19 vaccine as of the date of the Entry Form.
 
4. Task Force Ineligible. Members of the Tribe’s Executive COVID-19 Task Force are not eligible to submit an Entry Form or receive a prize under this Program.

5. Program Funding. The Program shall be funded from American Rescue Plan Act State and Local Fiscal Recovery Funds and/or other federally approved vaccination funding received by the Tribe that are allocated through the existing administrative and budgeting processes of the Tribe.

6. Program Procedures.
a) Drawing Description. The Program shall include three (3) Tribal Member Drawings and three (3) Team Member Drawings per month from December 2021 through April 2022.
 
i. Tribal Member Drawing: Tribal Member Drawings are open to all enrolled Tribal Members who are enrolled as of the date of the Entry Form and Tribal Member Drawing. Each Tribal Member Drawing prize shall be $5,000.
 
ii. Team Member Drawing: Team Member Drawings are open to Team Members who are employed by the Tribe as of the date of the Entry Form and Team Member Drawing. Each Team Member Drawing prize shall be $5,000.

b) Single Prize. Notwithstanding Section 6(c) of this Section, eligible winners may only receive one (1) prize under this Program.

c) Dual Eligibility for Tribal Team Members. Tribal Members who are also Team Members of the Tribe are eligible enter both Drawing categories and are eligible to win up to one (1) prize from each Drawing category.

d) How to Enter. Participants must complete an Entry Form online via the Tribe’s website. All requested information within the Entry Form must be completed to enter and to be eligible to win. Incomplete entries will be disqualified. The Tribe and its Team Members are not responsible for incorrect or inaccurate entry of information within Entry Forms.

e) Entry Window. The Program Entry Window shall begin as soon as reasonably possible after enactment of this Program and end on April 30, 2022 at 11:59pm ET.

f) Official Time Keeping. The Tribe’s internal website database clock shall be the official timekeeper for entries in this Program.

g) Drawing Procedure. Within ten (10) business days of the last day of a month that falls within the Entry Window, drawing winners shall be randomly selected from all eligible entries received in accordance with the deadlines stated in this Program. Business days shall include all days except Saturdays, Sundays, and all Tribally and Federally recognized holidays.

i. Winner Notification. The names and/or photographs of the winners shall be announced through the Tribe’s website and any other channels of communication determined by the Tribe. The winners shall be personally notified by telephone and/or e-mail, using contact information provided in the Entry Form. The Tribe is not responsible for any winner notification that is lost, intercepted, or not received by a winner for any reason.

ii. Vaccination Proof. The winner(s) of a Drawing must present proof that he or she received at least one (1) dose of an eligible COVID-19 vaccination as of the date of Entry Form. The winner shall have six (6) months from the date of the Drawing to provide vaccination proof to the Tribe’s authorized representative and to collect their prize. If a winner cannot provide such vaccination proof, he or she shall be ineligible to receive a Drawing prize and another winner may be selected. iii. Tribal Member Proof. Tribal Member Drawing winners must submit proof of their enrollment as of the date the Entry Form was submitted and as of the Drawing Date. Proof shall include, but is not limited to, a Tribally issued ID card. Tribal Members are not required to submit their Red Number to apply or receive a prize.

iv. Team Member Proof. Team Member Drawing winners must submit proof of their employment with the Tribe as of the date the Entry Form was submitted and as of the Drawing Date. Proof shall include, but is not limited to, a Tribally issued employment badge.

v. Prize Form. Prizes shall be awarded as a check made payable to the confirmed winner.

vi. Forfeiture. Despite the reasonable efforts of the Tribe, if a winner does not claim a prize and provide valid proof within six (6) months of the first notification attempt, such winner shall forfeit his or her prize and an alternate winner may be selected.

vii. Ineligibility. If a winner is found to be ineligible for a prize, or if he or she has not complied with the entry rules of this Program, such winner shall be disqualified, and an alternate prize winner may be selected.

a. Any participant who submits multiple Entry Forms or otherwise engages in a practice that violates the official rules of this Program shall be disqualified from the Program as determined by the Sault Ste. Marie Tribe of Chippewa Indians COVID-19 Executive Task Force in their sole discretion.

7. Official Rules. Official rules and regulations regarding the technical administration of the Program are attached hereto and incorporated herein by this reference as Exhibit A.

8. Taxes. Prizes are taxable and prize winners shall be solely responsible for all applicable federal, state, and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize. The Tribe shall issue a 1099 Form to all Drawing winners. Participants shall certify that they further agree to submit all necessary and applicable tax and accounting forms.
 
9. Governing Law. All issues and questions concerning the construction, validity, interpretation, and enforceability of this Program shall be governed by and construed in accordance with Tribal law. The Executive Task Force has sole discretion to make decisions related to the Program and its decisions are final and non-appealable.

The Sault Ste. Marie Tribe of Chippewa Indians (“Tribe”) Board of Directors established the COVID-19 Rescue Act Vaccination Lottery Program to respond to the COVID-19 public health emergency by motivating and increasing the number of people that get vaccinated sooner than they otherwise would have. The purpose of this document is to provide the Tribe’s M.I.S. Department with a restatement of rules associated with the Program.

Lottery Description

1. The Tribe will administer three (3) Team Member Drawings and three (3) Tribal Member Drawings per month for the months of December 2021 through April 2022. Restated, there will be six (6) total drawings per month, and thirty (30) drawings total.

2. All Entry Forms must be submitted online through the Tribe’s website.

3. Participants may only submit one (1) Entry Form and will subsequently be reentered into each month’s Drawings if they have not yet won a prize.

4. Notwithstanding Rule 5, participants may only receive up to one (1) prize. Winners shall be ineligible for future Drawings under this Program.

5. Tribal Members who are also Team Members are eligible to enter each Drawing category and are eligible to win up to one (1) prize from each Drawing category.

6. Entry Forms may be submitted as soon as reasonably possible after the enactment of this Program.

7. Entry Forms will not be accepted after April 30, 2022 at 11:59pm ET.

8. Prizes are taxable and prize winners shall be solely responsible for all applicable federal, state, and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize. The Tribe shall issue a 1099 Form to all Drawing winners. Participants shall certify that they further agree to submit all necessary and applicable tax and accounting forms.

Lottery Eligibility

11. Participants must be eighteen (18) or older at the time the Entry Form is submitted to be eligible for a prize.

12. No vaccination, enrollment, or employment proof is required at the time the Entry Form is submitted.

13. Drawing winners must provide proof that he or she received at least one (1) dose of a Pfizer or Moderna COVID-19 vaccine or (2) the single dose of the Johnson & Johnson COVID-19 vaccine as of the date the Entry Form was submitted.

14. Tribal Member Drawing winners must submit proof of their enrollment as of the date the Entry Form was submitted and as of the Drawing date. Proof shall include, but is not limited to, a Tribally issued ID card. Tribal Members are not required to submit their Red Number to apply or receive a prize.

15. Team Member Drawing winners must submit proof of their employment with the Tribe as of the date the Entry Form was submitted and as of the Drawing date. Proof shall include, but is not limited to, a Tribally issued employment badge.

16. Any participant who submits multiple Entry Forms shall be disqualified from the Program at the exclusive discretion of the Sault Ste. Marie Tribe of Chippewa Indians COVID-19 Task Force.

17. Members of the Sault Ste. Marie Tribe of Chippewa Indians Executive COVID-19 Task Force are not eligible to submit an Entry Form or receive a prize under this Program. As of the date of the enactment of this Program, the following individuals are not eligible to submit an Entry Form or receive a prize under this Program: Christine McPherson, Executive Director; Bob Schulte, Chief Financial Officer; Joel Shultz, Economic Development Director; Leo Chugunov, Health Director; Jeremy Patterson, General Counsel.

Prizes

18. The winner of each Tribal Member Drawing will receive $5,000.00.
19. The winner of each Team Member Drawing will receive $5,000.00.

20. The Tribe will contact prize winners with information provided in the Entry Form. Drawing winners will have six (6) months to claim their prize, prizes will be forfeited if they are not claimed in time.

21. Prizes shall be awarded as a check or electronic transfer made payable to the confirmed winner.

22. If a winner is found to be ineligible for a prize, or if he or she has not complied with the entry rules of this Program, such winner shall be disqualified, and an alternate prize winner may be selected at the Executive Task Force’s discretion.

Governing Law

23. All issues and questions concerning the construction, validity, interpretation, and enforceability of this Program shall be governed by and construed in accordance with Tribal law. The Executive Task Force has sole discretion to make decisions related to the Program and its decisions are final and non-appealable.
